Clean Energy Targets:
In 2020, WY adopted HB 200 requiring the Public Service Commission (PSC) to adopt rules to create an energy portfolio standard that requires utilities to generate a specified percentage of electricity generated from dispatchable and reliable low-carbon electricity, defined as carbon capture on coal facilities. The deadline to implement the standard is July 1, 2030. The PSC must also establish intermediate standards. The Wyoming PSC promulgated rules in Chapter 3, Section 38 of its rules requiring an initial application from utilities subject to the law by March 31, 2022 with a final plan due no later than March 31, 2023. HB 200 provides utilities with the opportunity for rate recovery for the installation of carbon capture, utilization and storage technology to achieve the standard. Companies that fail to comply with HB200 may not seek rate recovery for new electrical generation used to replace coal fired generation in Wyoming retired after 2024.
